I picked this up on Overlawyered: In a confidential settlement after a mediation, Nikolai Grushevski has resolved his complaint that he was turned down for a waiter job at a Corpus Christi location. They link to On Point News which has even more info: Hooters seemed to have a strong defense of “bona-fide occupational qualification” (BFOQ), which applies when the “essence of the business operation would be undermined if the business eliminated its discriminatory policy.”
